The hate crime statutes (and each state has their own) are sentencing adjustments, they simply reflect the notion that if you kidnap and torture a white kid BECAUSE he is white, you get extra time in jail. Kidnapping gets X, torturing gets Y, but if you do it based on some set of predetermined reasons, you tack on Z. They don't ge tacked on just because the victim is another hue, you have to have clear indications that their actions were motivated by hate.<br /><br />This is constitutional. Stated and the Congress have wide latitude in determine Pino's he still according to motivation. This goes to the whole concept of manslaughter, negligent homicide, murder 1, murder 2, what have you.<br /><br />Now, you can argue the propriety of hate crimes laws, but you can't argue their constitutionality.
